Molester Said to Leave Trail of Victims

SAN FRANCISCO - Despite being arrested at least nine times for molesting boys, Dean Arthur Schwartzmiller managed to avoid lengthy prison terms, coach Little League, move in with another convicted sex offender - and be named by authorities as one of the most prolific child molesters in history.

Schwartzmiller's criminal record began 35 years ago, but he never registered as a sex offender and spent just 12 years in prison. In his time on the outside, police suspect he molested as many as 36,000 children in several states, Mexico and Brazil.

Wily, charismatic and "smarter than heck," is how James Kevan, one of his defense lawyers in the mid-1970s, described Schwartzmiller on Friday. "He could write up legal documents better than most lawyers."

Often defending himself in court, Schwartzmiller got two of his four convictions overturned, even though the Idaho Supreme Court called him a repeat offender who "uses his intelligence to take advantage of the weak and oppressed and those who are in need."

With Schwartzmiller, 63, being held without bail on charges involving two San Jose boys, police and the FBI are trying to retrace his movements over the last 30 years.

A search of Schwartzmiller's San Jose home turned up spiral-bound notebooks with notes on more than 36,000 children, in categories such as "Blond Boys," "Cute Boys" and "Boys who say no" - together with codes appearing to indicate how he abused them, San Jose Police Lt. Scott Cornfield said.

Messages left for Schwartzmiller's public defender last week were not returned.

In court records released Friday, authorities said Schwartzmiller lived for five years with another convicted sex offender whom he met in jail - Freddie Everts, 34. The pair allegedly lured boys to their home with gifts including skateboards, video games and a motor bike.

Everts said Schwartzmiller claimed to be dying from an undisclosed illness and was keeping notes on his "encounters with boys" for a manuscript, according to court records. Everts is in jail on charges he failed to register as a sex offender.

Kevan - the former attorney who was later disbarred after having drug problems, he says - said he knew Schwartzmiller as Tim Miller, one of his dozen or so aliases, when they both lived in Mountain Home, Idaho, a small town near the Sawtooth Mountains.

"When I first met him, he was coaching a Little League football team. I helped him coach," Kevan said. "The parents all thought he was great. No one suspected a thing."

In retrospect, there were signs something was wrong - like the time he took the team to a game in Boise, and they "stopped in the desert to do a jock strap check." Kevan said he wasn't on the bus at the time, and only later realized that Schwartzmiller may have been picking out potential victims.

By that point, Schwartzmiller had already been convicted of molesting boys. His record appears to date back to 1970, when he was convicted in Alaska of lewd and lascivious conduct with three teen boys. He was sentenced to two years' probation, then indicted again two years later for molesting another boy - but he apparently fled the state before he could be tried.

Over the years, Schwartzmiller was convicted of molestation charges at least four times, but was acquitted once and avoided prosecution on other charges. When he first came to authorities' attention, there were no Megan's Laws or three-strikes laws, and Americans were less aware of the ramifications and the severity of child sexual abuse.

He called on Kevan for help when he was facing trial in Idaho in the 1970s on charges he molested two 13-year-old boys.

"I said, 'You've got to tell me what's going on.' He told me everything," Kevan said - outlining a history of molesting boys from Alaska down the West Coast.

Even then, Schwartzmiller had been keeping notebooks of his victims, with "a couple hundred" boys' names, followed by numbers that described each boy's anatomy, Kevan said.

"The investigators didn't know what they meant. They didn't even take them," Kevan said. "I told him to get rid of them."

Mountain Home Police Capt. Dave Pursell, who was on the force at the time, said he had no information about the notebooks. But he remembers Schwartzmiller well.

"He brought several suits against the sheriff here, and against the state and against anybody and everybody. In Idaho statutes there's a lot of case law related to Mr. Schwartzmiller."

Schwartzmiller spent about two years in prison on the Idaho charges before he appealed his conviction to the Idaho Supreme Court and won in 1978. The following year two 14-year-old boys said he molested them and he fled again - this time to Oregon, where he was arrested again, accused of bringing a boy from Little Rock, Ark. to San Francisco in June 1980. Authorities said Schwartzmiller had forced the boy into prostitution.

But the U.S. Attorney's office deferred prosecution to authorities in Idaho, where he served another six years in prison for molesting boys. By that time, Kevan had been disbarred, so he hired another attorney, Lance Churchill, who now works for a real estate company in Boise.

"He was famous as one of the best prison lawyers in Idaho," Churchill said. "He was respected because if an inmate needed help in a legal case, he would help them out. If he saw an injustice he would try to help the inmate. He was pretty well-liked out there."

In the years after Schwartzmiller was set free in 1987, he was arrested at least four more times for abusing children. He served three more years in Oregon, got out, was repeatedly arrested for violating parole and allegedly abusing other children, won an acquittal in Washington state, and fled rather than face arrest on another warrant in Oregon.

Joan Cavagnaro, the deputy prosecutor who tried the Washington case, said she had no doubt about Schwartzmiller's guilt, though she had no evidence like that found in the notebooks. Child abuse cases can be difficult to prosecute, Cavagnaro said, particularly when suspects target victims from troubled homes.

"Touching does not leave physical evidence," she said. "So you have one person's word against another and in the context of chaotic, dysfunctional family settings, this makes it a very difficult crime to prove."

Timberghotz, I regret to say that this US of A is NOT the great country it was when I was a young boy! You never heard of anybody putting razor blades or pins in Holloween candy, people were not affraid of leaving their doors unlocked. Mother's knew where their children were 24/7 and the cops walked a known area called their "BEAT" in the cities of America. Society as a general rule, was much more inclined to tow the mark of what was morally established as the proper things to do etc. The Devoice rate was 1/7 of what it is today people.

Satan has gained ground within our mist and that is because our country today is stridding further and futher away from what our forefathers, knew back then was the path to follow and that was the word of GOD in our society like it or not. I am not talking about religion folks, just GODS LAWS.....Amen!

Now what this country needs is less man made laws on the books and more of what I myself refer to as Judge Roy Bean Justice. Now waiting on death row for 15 years and letting tax payers foot the bill, for a convicted criminals law degree is ludicuos get my drift. NO more DWI convicted drivers for the 3rd, 4th and 5th time either. Those who sell drugs to minors or moleste children should be hung in the public square, so that all would see what is in store for those who commit such crimes. It worked back in the days of Fort Smith Arkansas people.

Our prisons have become over glorified places or rest,  for such vermon to educate themselves, while they have full access to the Gold Gym system, eat 3 square meals a day, wear clean clothes and do no hard labor during the day.  A pity the days of the chain gangs are over thanks to those liberals, who believe that the prison systems job is to educate those sent to such institutions. It used to be the goal of REFORM the criminal but the actual percentage in reforming such a person, is less than 1 out of 20. We the taxpayers pay the sum of over $60,000 dollars a year to keep a person on death row!!! I say that such money should be spent giving our kids money in the form of scholorships for  college or trade school instead. You might want to discuss that issue with your state & federal representitives. How many people does your state have on death row?

In my humble opinion, those who commit crimes against our children, should be treated like the words of Christ in the bible "It would be better for them to have a millstone tied around their necks and put into the sea" etc (hope I got that part of the passage near correct)........However, I myself think that public hanging would be more to naming that tune for justice sake. Some of you might want public cassteration  but that would not change the mind set of such people.

Hey All , this problem is world wide - these preditors are hurting Young people all over . Moment ago , they were talking about a sicko that paid to have sex with a 5 MONTH  OLD Baby !!!      Their should be a season opened on them  - first off .  Their isn't a punishment in place  that is fitting for crimes against Childeren  To Date ! It may be time to let Mother Nature Have a Crack at it .  Stake the SOB over a ant hill and just walk away .     Chain them to a tree and let Yogi and his buddies deal with it .  Now the punishment is befitting the crime .  But it still not even close to what the kids are put though !   I'm a strong believer - that world does not need these SOB !!  jUST MY FEELINGS . iT makes my blood boil !  Bullet

Fellas..I hear ya and Lil Mag,I remember when I was young my biggest fear was making my dad mad or my mom telling him I had been giving her trouble..The same went if the neighbors anywhere that lived up or down the road from us called and said I`d been a hoodlum...The fear of my dad taking me out behind the barn kept me staright..Those day are gone though..

My wife doesn`t like it because I say ,when these ****sacks are found guilty,the sentence should be on the spot and they go to a room down the hall for a 22lr bullet in the ear...I betcha that would stop these sick dirtballs knowing it is an instant death sentence..I wouldn`t mind watching em swing  on a short rope either though Lil Mag..And let everybody see the payment for being a sick peice of **** that preys on kids...Might as well take all the dope dealers,gang bangers,rapists,car jackers,murderers and let them have a bite of the retribution pie too!!!:wink:

Gentleman, call it cruel or unjust but I believe that public hangings, like those of yester years brought about a sence of awareness that spread across the land. A speedy trial and the sentence being carried out, are I am affraid a thing of the past!

Those public hangings help to keep many on their toes and walking a straight line. Nonetheless, our justice system is for those who make their living off of it and those who commit such crimes. The victoms of such crimes are left with a life of sorrow and little satisfaction of justice in the long run.

Notorious Canadian prisoner to be freed

MONTREAL (AP) - The most reviled woman in Canada is set to walk out of prison Monday, facing death threats and rage from a public still bitter that she only served 12 years for the rapes and murders of teenage girls, including her younger sister.



Karla Homolka is so frightened someone might harm her that her lawyers are demanding an unprecedented media blackout on her release and subsequent whereabouts, a move that will be challenged by media attorneys in a Montreal courtroom on Monday.

Many in this French-speaking city believe Homolka has done her time and should be given her second chance at life, which she got after making a deal with the state in exchange for testifying against her ex-husband.

Dubbed "English-Canada's monster," by Quebecois, the 35-year-old former veterinarian assistant who grew up near Niagara Falls has said she intends to settle in Montreal, hoping for anonymity amid those perhaps less familiar with her crimes.

Those offenses, when made public through her testimony at her ex-husband's murder trial in 1995 and from homemade videotapes of their sexual killing sprees, knocked the wind out of the nation.

Canadians, unaccustomed to the grisly crimes they typically attribute to their neighbors to the south, felt as if they had lost a touch of innocence.

Renewed interest in the killer, who now calls herself Karla Teale, has reached beyond Canadian borders. The Internet search engine Google reports Homolka was among their top 10 search subjects last week, just after Michael Jackson and Angelina Jolie.

Homolka was convicted of manslaughter in 1993 and given the relatively light sentence of 12 years for her role in the rapes and murders of Ontario teenagers Kristen French and Leslie Mahaffy. In return, she agreed to testify against ex-husband Paul Bernardo, a Toronto bookkeeper serving a life term in an Ontario prison for two counts of first-degree murder.

In sentencing Homolka, prosecutors also considered her role in the 1990 death of her 15-year-old sister, Tammy, who died on Christmas Eve after Homolka held a drug-soaked cloth over her face while Bernardo raped her.

Several psychiatrists who interviewed Homolka, who was often beaten by Bernardo - with a slew of hospital photos to prove it - claimed she was suffering from battered wife syndrome. She was given further leniency for her own mental state.

"She does seem to be very perturbed, yes, but she's done her time and either the system works or it doesn't," said Christian Immer, whose family lives next to the Elizabeth Fry Society halfway house for female inmates in the leafy Montreal suburb of Notre Dame de Grace.

Homolka has received counseling from the home, where she could stay in privacy while she finds a place to live and attempts to elude reporters.

The police and women who run the halfway house have refused to reveal whether Homolka will stay there, and Immer shrugs off any concern about the possibility.

"I have three kids and the thought crosses my mind, but she's probably the least of our fears in this big metropolis," said Immer, washing a car outside his house.

A criminal attorney, Immer blames the media for fueling the hysteria over Homolka's release from a prison just outside Montreal. One photo of Homolka glaring menacingly into the camera from beneath blonde bangs, has been printed and shown on television so often it's hard for some to picture her otherwise.

But Immer acknowledged the images of Homolka's sister, Tammy, won't soon be forgotten.

"I think people just can't fathom what she did to her sister, the idea of offering her sister to her husband for rape," Immer said. "It was a horrible, horrible, horrible story."

Months after prosecutors made the so-called "deal with the devil," Bernardo's attorneys handed over homemade videotapes by the couple. One indicated Homolka had offered up Tammy as a Christmas gift to Bernardo in 1990; it showed Homolka performing oral sex on her unconscious sister after slipping sleeping pills in her alcohol. Tammy died choking on her own vomit.

In the following two years, the couple kidnapped and videotaped the rapes and beatings of 15-year-old Kristen, then 14-year-old Leslie, who was strangled by Bernardo with an electrical cord while the teenager held a teddy bear Homolka had given her for comfort.

By the time the videotapes were revealed, the Homolka plea bargain had been sealed.

During Bernardo's trial, the prosecution insisted he had repeatedly beaten their star witness and threatened her family, so Holmolka had only pretended to enjoy the sexual abuse of the girls in an effort to protect herself, her other sister and parents.

Detractors said she had numerous chances to leave Bernardo. Letters to friends not long after Tammy's murder complained that her parents grieving for their youngest child was casting a shadow over her approaching wedding day.

The mayor of Notre Dame de Grace borough said he's received dozens of e-mails, letters and phone calls from constituents, most pleading that Homolka not be allowed to live among them.

Michael Applebaum said police had assured him that Homolka would be kept in another part of the city until the media frenzy dies down. "She won't be walking the streets anytime soon," Applebaum said.

The mystery surrounding Homolka's mental illness led Ontario prosecutors last month to seek, successfully, heavy restrictions on her movement and activities.

Homolka intends to appeal those restrictions, calling them a violation of her plea deal. Her lawyers also plan to return to court Monday to try, for a second time, to ban the media from reporting on her whereabouts once she is released from the penitentiary in rural Ste-Anne-des-Plaines, about 10 miles north of Montreal.

"I believe some people wish to do the public a favor by killing me," Homolka said in an affidavit accompanying the request for a media ban. "The thought of being relentlessly pursued, hunted down and followed when I won't have any protection makes me fear for my life."

Hells Bells, we got enough to take  care of right in our own backyard so ta speak! We have to many homeless people on our streets today and the biggest percentage are not bad folks.  Our nations drug problem has gotten  a heck of a lot worse in the last 5 years, especially in the last 2 years around us here. It would make a "Moonshiner" look like a  Deacon in a Southern Baptist Church on Sunday morning by golly.

If it isn't this Liberal organization making the news media with their agenda it's some other off the wall organization promoting it's self on TV and the news. I don't give a RATS BEHIND about Canada or any other place nowdays. I had enough of Canada 4 years ago when on vacation, they treated Americans like crap in Montreal and British Van Couver.

Nothing personel but I think we need to direct our resources to legal citizens of the USA  and stop letting all these other SOB'S, just skate into America FREE of charge. If you can't salute the flag, then get the hell out of this country. Now don't tell me you are a peaceable group of people practicing your religion, when that religion states " DEATH TO The INFIDELS" or translation being "THOSE WHO DON"T  CONFORM TO OUR WAYS OF ISLAM!!!...............So beware of the Trojan Horse that has come into our land people.
